Mikoyanovsky meat processing plant won a lawsuit against two companies from the Amur region

In November 2023, a Moscow manufacturer filed arbitration claims against Krestovozdvizhensky MEAT Processing Complex LLC and Art-Market Wholesale LLC. Both companies are registered in Blagoveshchensk. 

The dispute arose over the trademark “Pivchiki”. LLC Mikoyanovsky Meat Processing Plant acquired the exclusive right to use it from CJSC Mikoyanovsky Meat Processing Plant based on an agreement dated June 14, 2023. In the fall, the company’s legal service established that the stores of one of the retailers in the Amur region sold snacks under the same name, produced by Krestovozdvizhensky Meat Processing Complex LLC.

In November, the copyright holder appealed to the arbitration COURT with a demand to recover compensation from the manufacturer in the amount of 9,025,920 rubles based on twice the cost of the goods sold. By the same principle, taking into account the clarifications adopted by the court, the Mikoyanovsky Meat Processing Plant determined the amount of compensation for the trading company Art-Market Wholesale LLC - 1,201,560 rubles.

After evaluating the packaging design and comparing it with Mikoyanovsky’s trademarkmeat processing plant, the court concluded that there was obvious similarity to the point of confusion. The claims were fully satisfied.
