The company was registered in Barnaul in March 2021 - in the Prestige business center (on Sireneva St., 23/1), follows from rusprofile.ru data. But its founder is a Chinese citizen Wang Tianpeng, the DIRECTOR is Ruzimboy Akhmedov, a citizen of Uzbekistan.

In November of the same year, a company from Novosibirsk, Vector, concluded an agreement with her - perhaps they did not see any risks in working with a “newcomer” on the market. Novosibirsk undertook to supply poultry MEAT to the Barnaul company. And the first delivery - for 6.4 million rubles - was paid in full.

In 2022, Vector again shipped millions of chicken (broiler legs and thighs) to AMK Hang Seng. However, this time the buyer did not pay for the supplies in full - the debt, according to arbitration, amounted to 3.27 million rubles.

The counterparty from CHINA is to blame

The reality of the supply of poultry meat was confirmed by the Novosibirsk company with documents. The COURT accepted them. However, representatives of AMK Hang Seng believed that the company should not pay.

First, the debt is related to the delay in payment by an organization based in China (obviously, the products were intended for Chinese consumers), they said. And this, in their opinion, gives grounds for releasing the company from liability.

The court heard the position. But he did not accept, referring to the Civil Code. it is necessary to pay unless the debtor proves that he was unable to fulfill his obligations due to extraordinary and unavoidable circumstances. And violation of the obligations of counterparties does not apply to them.

Secondly, representatives of the company said that the delivered goods were of inadequate quality. True, no evidence was presented to the court.

In addition, the low quality of the goods was announced only after almost two months after the start of the process, the judge said. And he qualified the statement as an attempt to disrupt the meeting and drag out the process.

The third director

Now the Barnaul company with a Chinese founder will have to pay 3.2 million rubles plus a penalty to the Novosibirsk residents. The court of appeal issued its decision at the end of February and has not been appealed.

For a Novosibirsk company, this debt is significant - in 2021, its revenue, according to the same rusprofile.ru, amounted to 6.5 million rubles. The court has already issued a writ of execution, it follows from the data file of the arbitration.

But the likelihood of bailiffs recovering something from the company in practice does not look high. Information about her address is unreliable, rusprofile.ru points out, the activity is unprofitable. Yes, and with the leaders of the company, too, somehow not everything is clear.

So, initially, in March 2021, the director of AMK Hang Seng was a Russian citizen. Already in May, it was the Chinese Wu Shuang with the Omsk TIN.

Ruzimba Akhmedov, a citizen of Uzbekistan with a Krasnodar TIN, became the third director in two years. He headed the firm in January 2023, shortly after the decision of the court of first instance to recover 3.2 million rubles.

At the same time, Akhmedov himself is a director or founder of three firms in St. Petersburg . In general, bailiffs have something to think about.
