The creditor filed a corresponding application with the Arbitration COURT of Bashkiria. According to the plaintiff, Rosselkhozbank continued to lend to the dairy plant even when it had obvious liquidity problems.
As follows from the statement of the agricultural company, in 2012-2013 the Dyurtyulinsky Dairy Plant received loans from the Russian Agricultural Bank, but already in 2016 it did not have enough funds to pay off its debts. Despite this, the credit institution continued to finance production. At the same time, neither the bank nor the management of the enterprise applied to the court for bankruptcy.
“The bank, being a professional participant in the credit market, could not but understand that the issuance of the next tranche of the loan to the debtor would not allow him to restore normal business activities, but would only worsen his position and the position of other creditors of the debtor,” the statement says.
In 2016-2017 Rosselkhozbank continued to issue new loans. In total, the Dyurtyulinsky plant received five loans during this time. By 2017, the bank's share in the company's debt structure reached 50%. Thus, the credit organization actually controlled the plant, the statement says.
“The issuance of loans was not economically feasible for the debtor, since such financing could only lead to a postponement of bankruptcy,” said a representative of Agrofirma-Agrodar.
