The applicant intends to recover compensation from the manufacturer and retailer for the illegal use of the trademark “Pivchiki” (No. 291221), registered by the Federal Service for Intellectual Property (Rospatent) in April 2004. The name applies to sausages, sausages, sausages and meat delicacies, etc.

During market monitoring, employees of Mikoyanovsky Meat Processing Plant CJSC found out that the Krestovozdvizhensky meat processing complex produced raw smoked meat snacks called “Pivchiki”, sold through the Freshmarket chain of stores, owned by the trading company Art-Market Wholesale, at a price of 930 rubles per kilogram. The total weight, according to Rosselkhoznadzor , was about 6.27 tons.

As the exclusive copyright holder, the Mikoyanovsky Meat Processing Plant accuses the defendants of releasing counterfeit goods into trade. The capital company demands compensation in the amount of 11,658,480 rubles (based on the double cost of goods sold) from Krestovozdvizhensky Meat Processing Complex LLC, and 1 million rubles from Art-Market Wholesale LLC.

Preliminary hearings of the Arbitration Court of the Amur Region in two cases are scheduled for November 21 and 23.
