
For the first time, the Cherkizovo group submitted an application to the Federal Service for Intellectual Property (Rospatent) to register the trademark “Pivburgi” in August 2021, but in January last year received a preliminary refusal on the basis of clause 6 of Art. 1483 Civil Code of the Russian Federation.
The Office referred to the similarity of the designation with the trademark “PIVBURG”, previously registered by the company of the same name in relation to a number of snacks (anchovies and other fish products, processed nuts, potato chips and cereals, etc.). The goods were found to be homogeneous.
In September last year, PJSC Cherkizovo Group filed an objection to the Chamber of Patent Disputes, but in early December the panel supported the conclusions of Rospatent on the similarity of trademarks and homogeneity of goods, leaving the decision in force.
At the beginning of this year, the applicant filed a lawsuit with the Intellectual Property Rights COURT demanding early termination of the registration of the opposing trademark in relation to products of animal origin. The process ended in favor of Cherkizovo: the Pivburgi mark will be registered.
