The new version of the Code of Administrative Offenses of the Russian Federation (CAO) is planned to include for the first time fines for falsification of consumer goods.

The maximum fine for counterfeiting (including products) can be up to one million rubles. The article for the draft new code "Production and (or) circulation of counterfeit goods" provides for a fine with possible confiscation of goods for officials - from 50 to 100 thousand rubles, for individual entrepreneurs - 100-250 thousand rubles. For legal entities, the fine will be from 250 thousand to one million rubles.

The current Code of Administrative Offenses provides for punishment only for the circulation of counterfeit products and only for specific goods: medicines and medical devices, wine products, and bioadditives. For the first time, the draft new version of the Code of Administrative Offenses introduces an article that applies to almost the entire range of consumer goods that are produced and sold in the Russian Federation.

There is also an opinion that administrative responsibility should be introduced for non-compliance with GOST in relation to food products. “You can fight a lot, ensure public control, and when we get to some kind of judicial practice, it turns out that GOSTs are advisory in nature,” said a representative of one of the food industry associations. In his opinion, GOSTs for food products should be made mandatory.
