
Federal state land supervision on the territory of the Penza region in 2023 was carried out taking into account the “moratorium” on unscheduled inspections introduced by the Government of the Russian Federation of March 10, 2022 No. 336 “On the peculiarities of the organization and implementation of state control (supervision), municipal control” Part of the work was devoted to crime prevention.
In 2023, 540 control (supervisory) activities were carried out on the territory of the Penza region without the participation of land rights holders, including 369 on-site surveys, 171 monitoring of compliance with mandatory requirements, 139 preventive visits, 399 warnings were announced to land rights holders, 484 business entities were informed and Consulted on mandatory requirements and changes to current legislation.
Due to the presence of indicators of the risk of violation of mandatory requirements, as well as for the purpose of monitoring the implementation of regulations, 73 control (supervisory) activities were agreed upon with the prosecutor's office and carried out with the participation of land rights holders, including 45 inspection visits, 28 unscheduled inspections, which amounts to about 12% of the total number of control (supervisory) activities carried out in 2023.
Over the past period, within the framework of state land supervision in the Penza region, 184.9 thousand hectares of agricultural land were monitored, and violations of land legislation were identified on an area of 65 thousand hectares. In order to eliminate violations, 69 orders were issued; in connection with the execution of the issued orders, 5.1 thousand hectares of farmland were involved in agricultural turnover during the reporting period.
Based on the facts of identified violations, 73 protocols on administrative offenses were drawn up, 53 resolutions were issued on bringing to administrative responsibility, the amount of penalties amounted to 3,324 thousand rubles, 2,449 thousand rubles were collected over the past period.
Specialists of the Department, within the framework of the assigned powers, are working to identify facts of littering of agricultural lands and carrying out unauthorized excavation work. During the control (supervision) activities for the specified period, 18 cases of land littering with production and consumption waste on an area of 1.4964 hectares, 3 unauthorized quarries on an area of 10.65 hectares were identified, 2 cases of unauthorized removal and movement of the fertile layer of soil were suppressed. As a result of the measures taken, the violators eliminated 16 landfills on an area of 0.8964 hectares.
The Department of State Land Supervision is workingto monitor compliance with the requirements of the Federal Law of July 14, 2022 No. 248-FZ “On Livestock By-Products”. Within the framework of the allocated powers, 2 unscheduled inspections and 12 control (supervisory) activities were carried out without interaction with the legal holders of land plots on an area of 7023.94 hectares. During these activities, 64 soil samples were taken from areas where livestock by-products were stored and used. As a result of research, evidence of contamination of land plots as a result of the placement of cattle manure was established in 6 samples . Administrative measures have been taken against the rights holders of these land plots.
In order to identify facts of contamination of agricultural land with toxic substances and a decrease in soil fertility, inspectors sent 197 soil samples to the laboratory of the Federal State Budgetary Institution “ARRIAH”, of which 85 were samples for agrochemical indicators, 112 for chemical-toxicological indicators. According to the results of laboratory tests, an excess of benzopyrene content was detected in 4 samples, an excess of arsenic content in 2 samples, and a decrease in fertility in 31 samples.
In order to prevent fires on agricultural lands, joint control (supervision) activities were carried out with the Ministry of Emergency Situations ; 23 such activities were carried out. In almost every case, land plots overgrown with weeds and woody vegetation were identified, which pose a potential danger of the spread of landscape fires. Information about all facts of overgrowing of agricultural land identified within the framework of state land surveillance is transmitted monthly to the Ministry of Emergency Situations for taking response measures. As part of interdepartmental cooperation, information about 97 land plots was sent.
In order to implement Article 6 of Federal Law No. 101-FZ “On the turnover of agricultural land,” the Department is working to initiate the forced seizure of land plots from owners due to their non-use for their intended purpose or use in violation of the requirements of land legislation. Thus, in 2023, based on materials from the COURT Administration, 4 land plots with a total area of 36.8 hectares were confiscated from the owners in the Kuznetsk and Shemysheysky districts of the Penza region.
The activities of the Office in the field of state land supervision are widely covered in the media and on the official website of the Office. Also, information about the main violations of land legislation and mandatory requirements in the field of land legal relations is regularly posted on the website and in the media, in order to prevent crime, explain the rules of the law, and changes in current legislation. During the reporting period, 86 press releases were posted on the official website of the Office, 77 articles were published in newspapers, and 11 radio appearances were made.
