It was established that on August 12, 2002, the defendant, in a state of alcoholic intoxication, after a family quarrel, left the house, taking a kitchen knife with him. He got into a taxi driven by a victim he did not know before. During the trip, the driver found out that the accused did not have money to pay the fare, so he stopped the car at a public stop and asked the man to leave the salon.
In response, the defendant stabbed the victim in the heart with a knife. The driver ran out of the car, managed to reach the security point, where he died.
The Mogilev Regional Court issued a guilty verdict against the defendant, according to which he was found guilty of murder out of hooligan motives with a sentence of 15 years in prison.
An appeal was filed against the court's verdict, in which the accused challenged the qualification of the deed, asked for the verdict to be annulled and the criminal proceedings to be terminated.
The prosecutor, who participated in the consideration of the case in the court of appeal, expressed an opinion on the legality, validity and fairness of the verdict, asked that the court decision be left unchanged, and the accused's complaint - without satisfaction.
The Judicial Collegium for Criminal Cases of the Supreme Court agreed with the prosecutor's opinion.
