The circumstances of the accident with the death of a cyclist in the Gomel district have been established by the Investigative Department of the Investigative Committee of the Gomel Region, Maria Krivonogova, official representative of the Investigative Committee of the Gomel Region, told BELTA.
Investigators reconstructed the picture of that summer day. Thus, on the morning of July 8, a 41-year-old resident of the agro-town of Pokolyubichi saw off his common-law wife and children to the station, who were heading to the village. After that, he met a friend in Gomel, they chatted over ALCOHOL, and went to Pokolyubichi, where they added some alcohol. Then the resident of the agro-town offered his drinking buddy a ride in the family car, which his common-law wife drove. He was not bothered by the fact that he was intoxicated or did not have a driver's license. "He had previously been repeatedly brought to administrative responsibility for traffic violations both as a driver and as a pedestrian. At about 6 p.m., the defendant, driving a Volkswagen Golf, drove out onto Lenin Street in the agro-town and at a speed of 84 km/h, when the permitted speed is 60 km/h, hit a cyclist. The man was moving in the same direction along the right edge of the roadway. On that day, the 53-year-old local resident decided to ride his bike to the store. Suddenly, he was thrown sharply onto the windshield of a car. The driver of the Volkswagen Golf did not stop to help the victim, fled the scene of the accident, returned home and, together with his friend, pushed the car into the yard. Neither of them called an ambulance," the Investigative Committee reported.
Local residents approached the bleeding cyclist, and concerned drivers stopped. They dialed the numbers for an ambulance and the traffic police. Due to the injuries he sustained, the man died in the hospital a couple of hours later.
With the help of citizens, the suspect was identified the same day. Doctors found ethyl alcohol in his blood in an amount of at least 2.62 ppm.
The Investigative Department of the Investigative Committee of the Gomel Region opened a criminal case against a resident of Pokolubichi. "The fact that the defendant was driving a car at the time of the accident was confirmed by the testimony of witnesses, inspections of recordings from surveillance cameras installed on buildings along his route. According to the results of the investigative experiment and the conclusion of the forensic autotechnical examination, the driver could have detected an obstacle in the form of a cyclist on the road in advance and had the technical ability to prevent the collision by both standard and emergency braking," the Investigative Committee emphasized.
Based on the evidence collected in the case, a resident of Pokolyubichi was charged under Part 4 of Article 317 - violation of traffic rules by a person driving a vehicle in a state of intoxication.alcohol intoxication , which resulted in the death of a person through negligence, and Part 3 of Article 159 for deliberate abandonment in danger, committed by a person who himself through negligence placed the victim in a state dangerous to life and HEALTH of the Criminal Code. With the sanction of the prosecutor, a preventive measure in the form of detention was applied to the accused.
