Residents of the region sued the regional government because of QR codes

55 residents of the Kaliningrad region filed a lawsuit against the regional government in the regional COURT. They are trying to challenge three points of Decree No. 134 “On the introduction of a high alert regime on the territory of the Kaliningrad Region”, which requires that when visiting a number of public places a QR code about vaccination, a previous disease, or an up-to-date PCR test. The statement of claim says that the resolution does not comply with the provisions of federal legislation and the Constitution of the Russian Federation, and restrictive measures violate the right of citizens to freedom of movement. The applicants note that the spread of CORONAVIRUS infection in the Kaliningrad region has not been officially recognized as an emergency, quarantine has not been introduced in the region either, which means that there are no legal grounds for restricting the rights of citizens to freedom of movement and choice of place of residence.

The plaintiffs also believe that some paragraphs of the resolution unlawfully infringe on the rights of able-bodied and healthy citizens who do not have a QR code in comparison with those who have a certificate.

“This measure is direct discrimination and does not apply to measures aimed at protecting the HEALTH of citizens, since it is aimed at restricting the rights and freedoms of healthy, unvaccinated citizens whose public danger has not been proven,” the statement said.

According to the representative of the plaintiffs, lawyer Maxim Bulka, during the preparation of the lawsuit, citizens corresponded with Rospotrebnadzor and Kaliningradstat. According to the statistical office, 901 people died from covid-19 in the region in 2020.
