
May 15, Minsk. The Ministry of Antimonopoly Regulation and Trade has issued a warning to the Vitebsk Oblast Executive Committee, BelTA learned from the press service of the ministry.
"The actions of the Vitebsk Regional Executive Committee on the distribution of agricultural organizations that supply milk on the basis of contracts concluded between specific processing organizations, MART, are seen as signs of a violation of antimonopoly legislation. In particular, they contradict the norms of subparagraph 2.4 of paragraph 2 of Article 23 of the Law of the Republic of Belarus dated December 12, 2013 .№ 94-З "On counteracting monopolistic activity and the development of competition," the report says.
The department recalled that, according to Decree No. 70 "On the development of the agro-industrial complex of the Vitebsk region," the regional executive committee was granted the right, in agreement with the Council of Ministers, to form resource zones in the region on the basis of agreements on agro-industrial association.
"At the same time, according to the decree, only organizations whose property is in republican or communal ownership, in which Belarus or its administrative-territorial units have shares (stakes in authorized funds) in the amount of at least 50 percent, unitary enterprises, the founders of which are legal entities with a share of republican or communal property in the authorized capital of at least 50 percent," the MART explained.
In March last year, the Vitebsk Regional Executive Committee made a decision, which determined the agricultural organizations that supply milk on the basis of concluded contracting agreements. At the same time, all agricultural organizations of the region were included in the specified list.
In this regard, MART issued a warning to the Vitebsk Regional Executive Committee about the need to terminate Annex 2 to the decision and inform the regional executive committees of the region, as well as the agricultural organizations mentioned in the Annex, about its termination.
