The court refused to recover ₽119 million for the construction of a sports center in Ufa

The Arbitration Court of Bashkiria refused to satisfy the claim of the Ufa company "Sistema" against the general contractor for the construction of the Rima Batalova Sports Training Center - the company "Dortransstroy". The plaintiff demanded to recover from the defendant 119.1 million rubles of debt under a subcontract agreement.

In 2018, Dortransstroy, as a general contractor, hired the Sistema company to perform part of the work at a facility in Ufa on Kamyshlinskaya Street. In particular, Sistema had to equip the bypass road, carry out general construction work, pour foundations for the masts, carry out vertical planning and landscaping of the sports complex. The contract amounted to 183.4 million rubles, the work had to be handed over before May 2019.

The subcontractor performed work for the amount of 174.2 million rubles. Dortransstroy paid only 66.4 million rubles. After that, Sistema went to court, demanding to recover 107.8 million rubles of the main debt and 11.3 million rubles of a penalty.

“The defendant did not recognize the claims, in the response he indicated that the obligation to pay for the work was terminated by offset, he submitted offset acts to the case file,” the court’s decision says.

Dortransstroy indicated that the offset agreements fully cover the amount of the debt - 107.8 million rubles. On this basis, the court concluded that the settlements between the parties were completed. Sistema LLC did not appeal against the decision of the Arbitration.

The group of companies "Dortransstroy" is a major contractor for construction and road construction works in Bashkiria. In particular, the enterprise participates in the reconstruction of the federal highways M-5 and M-7, the overhaul of the Ufa-Orenburg highway. The company also took part in the construction of a new Belaya river embankment in Ufa. The organization is controlled by entrepreneur Ilgiz Valiullin. Revenue at the end of 2021 amounted to 7.5 billion rubles, and net profit - 32.3 million rubles.

Since July 2021, Sistema LLC has been under the supervision procedure as part of the bankruptcy case. The co-owners of the company are Artem Manushkov and Andrey Filippov. The company's revenue in 2020 amounted to 59.5 million rubles, and the loss was 155.3 million rubles. The company was a contractor for the construction of a school in the village of Tastuba, Duvan district, which became a problematic facility.
