Meat-packing plant "Consent" was unable to challenge the order of Rosselkhoznadzor

Meat-packing plant "Consent" tried to challenge in COURT the order of the territorial department of ROSSELKHOZNADZOR to bring the manufacturer to administrative responsibility, but the claim was rejected.

In April, inspectors from the Rosselkhoznadzor department for the Tyumen region, YaNAO and Khanty-Mansiysk Autonomous Okrug conducted an unscheduled inspection of the largest pig-breeding complex in the region, LLC Soglasie. During the bacteriological examination of samples of the products of the MEAT processing plant in the Central Scientific and Methodological Veterinary Laboratory, Salmonella were found in them. And this is not the only violation revealed at the enterprise. As a result, the zoosanitary status of the farm was lowered from IV to II level.

The company's management did not agree with the conclusion of the specialists, and in early May, the veterinarian of Soglasie LLC, Yuri Pavlov, announced his intention to challenge the results of the check in court. He questioned the presence of pathogenic microflora in the products, substantiating this with documented regular studies in an accredited laboratory. According to Pavlov, the company orders them twice a month for seven years, receiving conclusions about the absence of any pathogens.

The judge, who dismissed the claim, referred to the fact that it did not indicate the circumstances on the basis of which each item of the prescription of the supervisory agency was disputed, and there were no references to the necessary evidence. He clarified that the arbitration takes into account only those evidence that are directly related to the case before the court. The amended application of Soglasie LLC can be submitted until June 21, 2021.
