No, they explained in the Russian Bar Association. It all depends on the type of land. In this case, the problem of the woman and her chickens was that the plot was intended for gardening. So, no one has the right to moo and crow there on an ongoing basis, decided the state inspection of the Volgograd region for the use and protection of land. The Supreme Court of the country agreed with this. So all the layers and cows lurking in the gardens have cause for concern.
"The category of land and the type of permitted use are the main characteristics of a land plot, determine its essence and the procedure for use," said Maria Spiridonova, a member of the Association of Lawyers of Russia. "You can't live without this type of permitted use. In addition, at the municipal level, the authorities also establish the Rules for Land Use and Development, compliance with which is also mandatory. You can start livestock if your site belongs to a personal subsidiary plot."
In turn, Natalia Skryabina, a member of the AJUR, said that judicial practice develops in different ways: the owner can expect both a fine for an administrative offense and a warning. But in any case, it is better not to tempt fate and check the category of your land, what can be done on it, what cannot.
“If we talk about the categories of land for the potential dacha life of citizens, then there are two of them: agricultural land and land of settlements,” explained Natalya Pshenichnikova, senior lecturer at the Department of Legal Regulation of Business and Applied Law at Synergy University. “Hangars can be built on agricultural land , greenhouses, sheds, etc. Residential buildings cannot be built there."
Types of permitted land use
1. Land for personal subsidiary farming (LPH); in such areas it is possible to breed chickens and livestock, cultivate crops, keep bees, etc.
2. Land for agriculture. In such areas, you can also keep any agricultural animals.
3. Land for individual housing construction (IZHS). The breeding of cattle and pigs in such areas is prohibited, but the legislation does not say anything about poultry, says teacher Natalya Pshenichnikova. "It is necessary to focus on the regulatory framework of a particular region. Perhaps it is in the legislative act of the region that a ban on breeding birds on lands for individual housing construction is established. 4. Land for gardening and horticulture. "It is forbidden to breed any non-domestic animals on them. Chickens, geese, goats and turkeys are not pets," Natalya Pshenichnikova emphasizes.
