
The Parliament of Bashkiria in the first reading adopted a bill on the abolition of fines for violation of the mask regime. it implies the recognition of Article 13.19 of the Code of Administrative Offenses of the Republic of Belarus as invalid. Amendments are made due to duplication of liability provided for such violations in the Code of Administrative Offenses of the country.
Article 13.19 provides for liability for failure to comply with the requirements of the regulatory legal acts of the region adopted to counter the spread of covid-19 - violation of social distance and mask regime. Fines under it for citizens range from 1 thousand to 3 thousand rubles, for officials - from 5 thousand to 15 thousand rubles, for legal entities - from 50 to 100 thousand rubles, for repeated violations the maximum amount of fines rises to 5 thousand, 30 thousand and 200 thousand rubles, respectively. Such a norm was established by Parliament at the very beginning of the CORONAVIRUS pandemic.
“It was necessary in order to prevent the rapid spread of the virus. At that time, we had little information about the new coronavirus, and there were no vaccines at all. Unfortunately, not everyone understood the scale of the problem. The fines prompted some citizens to behave more responsibly towards themselves and those around them. Over time, a similar norm was established by federal legislation, and the need for a republican norm disappeared,” commented Konstantin Tolkachev, speaker of the regional parliament.
According to him, the abolition of the article on fines for violation of the mask regime in the Code of Administrative Offenses of the region will reduce excessive administrative pressure on businesses and residents of the republic.
At the federal level, liability for violators of the mask regime is provided for under article 20.6.1. Fines for citizens under it range from 1 thousand to 30 thousand rubles, for officials - from 10 thousand to 50 thousand rubles, for legal entities - from 100 thousand to 300 thousand rubles, for persons engaged in entrepreneurial activities without formation of a legal entity - from 30 thousand to 50 thousand rubles. For repeated violations, more significant fines are provided, as well as disqualification of officials for a period of one to three years and suspension of activities for up to 90 days.
As RBC Ufa reported, from January to March, the regional courts considered 9.3 thousand cases under Article 20.6.1. 7.5 thousand offenders got off with warnings. 1.22 thousand citizens, individual entrepreneurs and legal entities were fined a total of 7.09 million rubles. The rest of the cases were dismissed or referred to jurisdiction. In 2021, under this article of the Code of Administrative Offenses of the Russian Federation, 12.04 thousand fines were awarded for a total amount of 40.7 million rubles, 41.3 thousand violators received warnings.
