Criminal liability and alcohol trafficking: what innovations are being introduced into legislation

At the meeting of the tenth session of the House of Representatives of the seventh convocation, deputies adopted in the second reading the bills “On amending codes on criminal liability” and “On amending laws on the production and circulation of alcoholic beverages,” BELTA reports.

The first bill provides for adjustments to the Criminal, Criminal Procedure and Criminal Executive Codes of Belarus. it is aimed at improving legal relations in the field of imposing and executing criminal penalties and other measures of criminal liability, preventing crimes against sexual integrity committed against minors, and bringing codes into compliance with the Constitution and other legislative acts.

In particular, the bill provides for the expansion of opportunities for convicts to acquire competencies (knowledge, abilities, skills) that are significant for social adaptation and to overcome negative personality traits (habits, inclinations, addictions). It is also expected to establish the possibility and determine the procedure for carrying out preventive monitoring and control over persons released from punishment conditionally on the basis of an act of pardon.

The bill also provides for the possibility of establishing preventive supervision over persons who have committed crimes against sexual inviolability against minors, until their criminal records are expunged or expunged. The COURT may also impose compulsory security measures and treatment, along with punishment, against such persons suffering from pedophilia.

The bill outlines the possibility of providing psychological assistance to convicts registered with penal inspections. In addition, a procedure is established for sending persons sentenced to arrest to the place of serving their sentences.

As for the bill on the production and circulation of alcoholic products, it provides for a number of innovations. It is proposed to assign to the state the exclusive right to import alcoholic products and determine cases when such a right does not apply to alcoholic products imported into the territory of Belarus. It is also envisaged to link to the basic values ​​the minimum size of the authorized capital of legal entities, upon reaching which the right to import alcoholic products is granted (at least 24 thousand basic values, currently at least 250 thousand euros).

The bill provides for granting the government the right to determine the conditions and procedure for excluding organizations from the list of legal entities engaged in the production of original alcoholic beverages and making changes to this list, securing the right to wholesale alcoholic beverages to government agencies for use during official events, and allowing any methods of payment for alcoholic beverages. products with persons who are in liquidation proceedings in a bankruptcy case, as well as with persons held by the court to subsidiary liability after the opening of liquidation proceedings.
