Dispute between Cherkizovsky Meat Processing Plant (ChMPZ) and meat producer Tsaritsyno Etalon


This controversy has created waves in the MEAT industry and has become the subject of widespread discussion. The parties are currently in the process of negotiations on the possibility of concluding a settlement agreement, however, the managing partner of Semenov & Pevzner, Roman Lukyanov, notes that satisfying the requirements of ChMPZ in full could lead to bankruptcy of the defendant, given its net profit in 2023, which amounted to only 7 million rubles according to RAS.

Based on the experience of legal practice, the courts in such cases often satisfy the demands only partially in order to avoid the financial ruin of the defendant. The previous case, when ChMPZ filed a lawsuit against the agricultural firm Ariant for violation of exclusive rights to the Borodinskaya trademark, ended in a settlement agreement after the defendant admitted the violation and agreed to pay compensation, although the amount of 120 million rubles was initially required.

The case was yet another example of intense competition and intellectual property protection in the meat industry. The fate of the dispute between ChMPZ and Tsaritsyno Etalon remains uncertain, but it highlights the importance of protecting brands and trademarks in a highly competitive market.
