The dispute over the pledge in the form of dead piglets of the ruined Kursk "Reut" reached the cassation

The Arbitration COURT of the Central District has not yet accepted the complaint for proceedings. In November last year, the Arbitration Court of the Kursk Region, as part of a bankruptcy case, refused to recognize the claims as collateral for Shchigrovsky KHP, which would significantly increase the chances of their satisfaction compared to other creditors. The company tried to appeal the decision, but in February the 19th Arbitration Court of Appeal upheld it.

Recall that almost 4,000 piglets, which had to be eliminated due to an outbreak of ASF at the Reut pig farm in 2020, are the subject of pledge. The lower courts came to the conclusion that the collateral was in fact absent, so there were no grounds for satisfying the company's application. In addition, the court found that the pledge had not been entered into the public register on time.

The pledge agreement between the companies was concluded on November 20, 2020. And just 10 days later, the administration of the Kursk region published a decree on the removal of animals and the elimination of ASF outbreaks. Reut, in a separate dispute, is trying to recover from the Kursk authorities 224.4 million rubles of damages due to the seizure of pigs, including those pledged to the Shchigrovsky bakery.

Recall that Reut owed more than 4 million rubles to the Shchigrovsky KHP for the supply of feed under an agreement concluded back in July 2019. In March 2021, the court ruled to recover this amount in favor of the counterparty. The non-payment of the debt became the reason for the bankruptcy claim against Reut, in respect of which bankruptcy proceedings were introduced in April 2022.

Reut LLC was registered in 2019 in Kursk. The main activity is pig breeding. The enterprise belongs to Oleg Sozansky. According to Kartoteka.ru, the company's revenue in 2020 amounted to 829.3 million, with a net loss of 33.26 million rubles. Subsequent years were not published.
