According to the case file, the drunk accused got behind the wheel of a Nissan Primera. The passenger sitting next to him was also drunk and not wearing a seat belt. When the driver backed up, she fell out of the car. The driver drove over her. The victim died in the hospital.
The defendant tried to hide the fact of driving a car and being in a state of intoxication. However, ethyl alcohol was found in his blood at a concentration of at least 1.72 ppm, the prosecutor's office said.
It is known that from 2013 to 2021, a man was brought to administrative responsibility 23 times for traffic violations, including driving while intoxicated and driving a car by a person who does not have the right to drive.
The prosecutor studied the materials of the criminal case and concluded that the accusation was justified, that there was sufficient, relevant and admissible evidence of the motorist's guilt. According to his conclusion, the circumstances of the crime were investigated fully, comprehensively and objectively. He also agreed with the qualification of the deed under Part 4 of Article 317 of the Criminal Code.
The previously chosen measure of restraint in the form of detention was left unchanged.
