COURT the state prosecution in a criminal case against a 39-year-old city resident who was charged with violating traffic rules in
ALCOHOL intoxication , which through negligence resulted in
the death of a person and the infliction of serious bodily harm, as well as leaving one in danger. BELTA was informed about this by the information service of the Gomel Region Prosecutor's Office.
As
it was established, a
drunk driver in a Mitsubishi Galant hit two people at a pedestrian crossing on Efremova Street on January 1 of this year at about 2.15. At the same time, he did not take into account that in the next lane on the right in the same direction in front of the pedestrian crossing, a BMW car slowed down and stopped. He himself did not take measures to reduce speed and committed a fatal accident. A minor boy died at the scene from his injuries, and a second pedestrian suffered serious injuries.
“After the incident, the accused tried to escape, leaving the victims in danger and without providing them with urgent assistance. However, thanks to the coordinated actions of an eyewitness to the incident - the BMW driver, who began to pursue him, traffic police officers detained the defendant,” the prosecutor’s office recalled.
According to the conclusion of a forensic auto-technical examination, from the moment the “Pedestrian Crossing” road sign was visible, the accused had the technical ability to stop the car to the nearest border of the pedestrian crossing.
“The concentration of ethyl alcohol in the blood of the accused was at least 2.82 ppm. It was established that the driver had consumed
alcohol immediately before the accident. After a family quarrel, he got behind the wheel and drove home. In the car with him were
drunken wife and two children. Previously, the accused was repeatedly brought to administrative responsibility for violating traffic rules,” the regional prosecutor’s office said. At the trial, the man admitted guilt in the accident. In his justification, he explained that after the incident he wanted to take his family
home to protect his wife and children from the proceedings.
Taking into account the evidence presented by the state prosecutor, the Zheleznodorozhny District
Court of Gomel pronounced a guilty verdict. Based on Part 4 of Article 317, Part 3 of Article 159 of the Criminal Code, the accused was sentenced to 8 years of imprisonment to be served in a correctional colony under general regime conditions. Also on The defendant is deprived of the right to engage in activities related to driving vehicles for 8 years, plus a 100 BV fine - Br4 thousand. The verdict has not entered into legal force and can be appealed.
