You need to know that in Belarus, after a spouse divorces, their common children can remain with both their mother and their father. There is an opinion that the mother has priority in this matter, but this is not so. Belarusian legislation provides for equal rights and responsibilities of parents in relation to their children.

The COURT cannot leave minors with a parent who abuses ALCOHOL or drugs, has mental illness and, as a result, is unable to provide adequate conditions for the growth and development of children. It doesn't matter whether it's the mother or the father.

Parents can enter into an agreement about the children, in which they settle the place of residence of the children after the divorce, that is, which parent they will stay with; the right to participate in the upbringing of children of a separate parent and the issue of collecting alimony. This is the most favorable option. Such an agreement is concluded with a notary.

When making a decision on a dispute over determining a child’s place of residence, the court must take into account his opinion if he has reached ten years of age.
If spouses have several children together, they do not necessarily all remain with one of the parents. For example, if there are two children, then one can stay with the mother, and the second with the father. This issue is resolved either in the agreement on children or in court.
