MINSK . Following the examination of the complaint, the Minsk
Prosecutor's Office filed protests with the COURT against the decisions to bring a 54-year-old woman to administrative responsibility - the illegal decisions were cancelled, the administrative offence cases were dismissed. This was reported to BELTA by the Prosecutor General's Office.
it was established that by the decisions of the Internal Affairs Directorate of the Frunzensky District Administration of Minsk, the woman was brought to justice for appearing in a public place in a state of
ALCOHOL intoxication and petty hooliganism under Part 1 of Article 19.3 and Article 19.1 of the Code of the Republic of
Belarus on Administrative Offenses. By the decisions of the Frunzensky District Court, she was held liable for appearing in a public place in a state of alcohol intoxication, committed repeatedly under Part 2 of Article 19.3 of the Code of the Republic of Belarus on Administrative Offenses.
The prosecutor's office , having studied the case materials, found out that the persons conducting the process, during the preparation of cases of administrative offenses for consideration and when drawing up protocols on administrative offenses, did not take appropriate measures to establish the identity of the offender. Personal data was entered into the protocols based on his words and information from the IS "Passport", while the detainee did not have documents proving his identity. Thus, the person who actually violated
the law used the personal data of the applicant, who did not commit administrative offenses.
The Minsk City Court and the Frunzensky District Court of the capital satisfied the prosecutor's office's protests. The administrative offence cases against the applicant were dismissed due to the absence of elements of an administrative offence in her actions.
