February 26, Mogilev. A Mogilev resident was sentenced to seven years in prison for a fatal accident involving a motorcyclist, BELTA learned from the information service of the Mogilev Region Prosecutor's Office. The Mogilev City
Prosecutor's Office upheld the state charges against the 44-year-old local resident, who is accused of violating traffic regulations while intoxicated.
Alcohol intoxication , resulting in the negligent
death of a person, as well as knowingly leaving a person in danger.
It was established that on September 7 of last year,
the intoxicated defendant was driving a Ford Transit along Lazarenko Street in Mogilev. Approaching the controlled intersection with Burdenko Street, he intended to turn left. Acting carelessly and inattentively, without ensuring the safety of his actions and the absence of oncoming traffic, he failed to yield to a Yamaha motorcycle traveling straight ahead when the traffic light turned green. As a result, the Ford driver caused the motorcycle to collide with his car.
After the accident, the defendant, being obligated and able to provide first aid to the victim, fled the scene, leaving the motorcyclist in danger, which resulted in his death.
During the trial, the defendant pleaded not guilty. He explained that he was driving while sober and only consumed
alcohol after the accident. He failed to provide the necessary assistance to the motorcyclist at the scene of the accident, believing him to have died during the collision.
Taking into account the evidence presented by the state prosecutor, the Leninsky District
Court of Mogilev returned a guilty verdict. Pursuant to Part 4 of Article 317 and Part 3 of Article 159 of the Criminal Code, the defendant was sentenced to seven years' imprisonment in a general-regime penal colony for the combined offenses, with a driving ban for eight years, and a fine of 100 basic units.
The
court also granted the victims'
claims for a total of Br80,000.
The verdict has not entered into legal force and may be appealed.
