In November 2023, a state inspector of the department of state land supervision for the Penza region of the Office of ROSSELKHOZNADZOR for the Republic of Mordovia and the Penza region conducted an inspection visit to the owner (citizen R.) of an agricultural land plot with cadastral number 58:25:0060301:289, located in Serdobsky district. During this event, the fact of non-compliance with the order was revealed, which ordered to eliminate the overgrowth of the land plot and use it in accordance with its intended purpose.
In connection with the revealed fact of non-fulfillment of the order in relation to the owner of the land plot, a protocol on an administrative offense was drawn up in accordance with Part 25 of Art. 19.5 Code of Administrative Offenses of the Russian Federation. The materials of the administrative case were transferred to the COURT for consideration on the merits.
On November 29, 2023, based on the results of the consideration of the case, the court came to the conclusion that citizen R. was guilty. The justice of the peace made a decision to bring the owner of the land plot to administrative liability in the form of a fine of 10 thousand rubles. The resolution came into force.
The violator of the land legislation was re-issued an order to eliminate the violation, which will be monitored within the prescribed time frame. If this violation is not eliminated, the issue of forcibly confiscating this land plot from the owner and selling it at auction will be considered.
