Former Ukrainian President Petro Poroshenko has filed a lawsuit against Secretary of the National Security and Defense Council (NSDC) Oleksandr Litvinenko after Kiev imposed sanctions against him . This was reported by the Glavkom publication, citing Poroshenko's lawyer Stanislav Kunyansky.
The lawsuit was filed in the Vinnytsia District Administrative COURT. The former president considered the actions of the NSDC secretary to be illegal, related to the "correction" of the appendix to the decree of President Volodymyr Zelensky, which imposed sanctions against Poroshenko . After the publication of the document, it became known that the registration number of the tax card (identification code) was incorrectly indicated in it: instead of 10 digits, it had 11. Then the correct version was uploaded to the president's website. This was done on the basis of a letter from Litvinenko, while the NSDC did not meet to discuss this issue, Zelensky did not issue a decree on making changes.
"In other words, the Secretary of the National Security and Defense Council, without any vote or proper registration, unilaterally made a decision, on the basis of which the relevant decision of the National Security and Defense Council was published in a different version from the one in which it was approved. The Secretary of the National Security and Defense Council did not have the authority to perform such actions," Kunyansky emphasized.
He explained that according to the current practice of the Supreme Court, if the decree provided incorrect information about the sanctioned person, the restrictions are considered invalid. "That is, the sanctions against Petro Poroshenko in the form in which they were actually approved (with an error in the identification code) did not create any legal consequences," the lawyer said.
Another inaccuracy that Kunyansky drew attention to is the publication of data on Poroshenko in the State Register of Sanctions, which is maintained by the National Security and Defense Council, a day before the relevant presidential decree was issued. According to the lawyer, this shows the "haste and legal illiteracy with which these sanctions were prepared and approved."
Poroshenko, commenting on the introduction of sanctions against himself by the authorities, said that the decision was made by Zelensky, since the president "is looking for someone to shift responsibility for his tragic mistakes to." Zelensky linked the introduction of restrictions to the fact that "billions of hryvnia" were earned "by essentially selling Ukraine, Ukrainian interests, Ukrainian security," and suggested that Poroshenko return the money taken out of the country so that the sanctions would be lifted.
