Lawyers interviewed by RBC assessed how the order of Roszdravnadzor will work. Its territorial departments are now required to report citizens who participate in the anti-vaccination campaign, while they were ordered to pay special attention to anti-vaccination doctors.
They will report to the territorial investigative bodies and the prosecutor's office about citizens "whose activity has signs of offenses, the responsibility for which is provided for in Articles 207.1 and 207.2 of the Criminal Code." Article 207.1 of the Criminal Code describes the public dissemination of deliberately false information about circumstances that pose a threat to the life and safety of citizens. Article 207.2 deals with the same crime, but with grave consequences.
According to the law, deliberately false information is understood as information that initially does not correspond to reality, which was reliably known to the person who distributed it, Alexey Goryainov, a medical lawyer and representative of the European Association of Medical Law in RUSSIA, said in a conversation with RBC.
“In this sense, it is very curious how the deliberate unreliability will be proved if a person either expresses his own opinion, for example, a DOCTOR, perhaps even in a categorical form. But after all, even clinical studies were not carried out in full, and therefore the scientific approach has certain blank spots. Therefore, if such cases are considered, then even on the part of the state prosecution it will not be easy, ”he believes.
