In December 2021, Vladimir and Marina Sholom secured compensation for land plots on the Belaya Embankment

The 18th Arbitration Court of Appeal in Chelyabinsk dismissed the complaint of the Ufa administration against the decision of the Arbitration Court of Bashkiria in the case filed by scientist Vladimir Sholom and businesswoman Marina Sholom. The mayor's office still has to pay them 40.1 million rubles. The appeal only changed the wording of the decision. The money will be paid to the plaintiffs not at the expense of the city treasury, but from the funds of the Department of Land and Property Relations of the Ufa Administration.

As RBC Ufa reported, in December 2021, the Arbitration Court of Bashkiria partially satisfied the claim of Vladimir and Marina Sholom to recover compensation for land plots on the embankment of the Belaya River near the Yunost pool.

In 2017, the Ufa administration entered into an agreement with the Sholoms to seize a 4,047 sq. m. In return, the city provided them with three plots of a similar area, located nearby. Thus, the city and the owners of the plots made an exchange.

However, in 2019, this deal was declared invalid by the court, since the Sholoms received ownership of land on the territory of common use - such land cannot be privatized by law. Thus, they lost both the former site and the new ones. In this regard, the plaintiffs demanded monetary compensation from the city.

“In the case under consideration, the defendant's obligation to transfer funds arose by virtue of law and in connection with the failure to fulfill a civil law obligation, and not as a result of causing harm (tort). Thus, compensation for the seized land plot for municipal needs should be carried out by the municipality of the urban district of the city of Ufa of the Republic of Bashkortostan represented by the land and property relations department of the administration, ”the court decision says.
