“Does not violate rights”: Rospotrebnadzor on the lawsuit of suspended employees

Ravil Shakirov, a leading expert in the legal support department of the Rospotrebnadzor Administration for the Perm Territory, commented in an interview with RBC Perm on the preliminary meeting of the Perm Regional COURT, which considered the mass lawsuit of Perm residents against the chief state sanitary DOCTOR of the Perm Territory, Vitaly Kostarev. According to him, Decree No. 206 was adopted in accordance with the legislation of the Russian Federation and does not contradict it.

“Since the resolutions were adopted by an authorized official, the resolution was adopted in the manner prescribed by the legislation of the Russian Federation, the resolution does not violate the rights and legitimate interests of the administrative plaintiffs. The absence of preventive vaccinations entails a number of legal consequences provided for in Article 5 of the Federal Law No. 157 “On Immunization of Infectious Diseases”, including the possibility of refusing to hire a citizen, as well as removing a citizen from work. In turn, the employer is obliged to organize preventive vaccinations against a new CORONAVIRUS infection for all employees from the areas set out in paragraph 1 of the resolution of the chief state sanitary doctor for the Perm Territory No. 206. But at least 80% of the payroll of the team, taking into account citizens who have recovered from covid-19 " ,

Earlier, RBC Perm reported that a preliminary hearing was held in the Perm regional court on the suit of Perm residents against the HEAD of the regional department of Rospotrebnadzor Vitaly Kostarev. They demand to cancel his decree on mandatory vaccination against coronavirus for employees of enterprises.

The main plaintiff, Yekaterina Efimova, was suspended from work by management due to her refusal to vaccinate. According to a source from RBC Perm, the interests of people in court are represented by lawyer Tamara Demeneva. There are 250 plaintiffs in the case.

Initially there were 2 claims, but they were combined into one. Basically, individual entrepreneurs, the unemployed and employees of PJSC T Plus came to the court to defend their rights.

Also, mandatory vaccination is subject to employees of the Ministry of Internal Affairs of RUSSIA, the Russian Guard, institutions of the penitentiary system, customs officers, persons working on a rotational basis, volunteers, persons living in social service organizations, persons aged 60 years and older.
